I'm sorry, partridge, but I can't leave your comments last night unanswered. Though I wish all of you would stop having this same tired discussion, and I'm loathe to discuss it again, I am compelled to correct the record.

The record of the OT reflects that, this time around, cobble was the assailant, and *rob* was the victim. And cobble was the assailant and Arkady and I were the victims. I realize that cobble portrays herselfs as the victim and that you and a few others have bought into, but I'm not going to sit on my hands while you re-write history.

Here is how the latest round began. Note that I was NOT even in the OT that Saturday:

Cobble - January 5th - 4:46pm:
"Oh great, looks like Arkady and CGar got their Xmas wish. Bully for them."

Then on Sunday, cobble started again with her very first post of the day, and only the second post in the OT, at which point I jumped in to defend myself, since my days of being cobble's whipping boy are over.

Cobble - January 6th - 8:05am:
"Ok, I'll say it, as a 'non-Believer'. Was there a brokered back room deal for the Return of Rob? Or did installing self-registration bring this on? A 'Believer' has said that only Snappy has a legitimate beef with rob. Did he apologize to her, or BHS? And where will the line be next time?"

Finally, partridge, I will note that neither you nor any of the others who leapt to cobble's defense said a single word in my defense or Arkady's defense. Not one word about how we were attacked without provocation. Your knee-jerk reaction was go into defense of cobble mode. So, thanks so much for your concern, but I'm doing fine now.

Huh? You really put the P in PLUSA if you can't handle a truthful statement that your wish came true after spending months making it very clear that you wanted him back. That's was the "attack" that I should have spoken out against and rallied to your side? Really? You can't handle THAT all by yourself?

And yes, for the record so that everyone is perfectly clear, I really like Cobble. There, I said it! She is the main reason why I came here. She is funny and smart and a loving person but I shouldn't have to tell you all that because you have been such close friends for so many years, you know it too.

I'd add that the one who comes best out of all this is Scott who said several times that *rob's* return happened because of work he -Scott- had done on the site & who further added that he thought *rob's* apology was the closest anyone had ever come on the OT to being sincere & well intentioned.

I considered leaping in here but decided that I have enough totally disfunctional bullshit going on in my "real" family (including my daughter who of course is not "real" in the genetic sense of the word) (and including me too!).

For once I think I agree with DCB. Enough with the he-said-she-said. I do miss Cobble and I hope she comes back soon, but I think she can take care of herself. I wrote to her yesterday to tell her that I miss her and to say that others have posted expressing the same sentiment. She seems to be surviving life without lifeinbklyn.

Actually, I agree with the sentiment that we should look to the present and future, and not get so caught up over the past.
There have been plenty of ugly things said by many people, and more than enough blame to go around (including myself). I don't like it, but I move on. When I things get particularly ugly, I withdraw for a bit.

Tell them you don't speak English. Just make sure you do not get up with all the other idiots to be interviewed when they anounce -- in English -- that all the non-English speakers should go see the clerk.

If you are on a voir dire panel, tell them you have a blog friend who sues insurance companies so you know all about where the real money is. [I love scaring the shit out of other lawyers, epsecially since I'm so nice.]

Biff, I agree with DCB and Pete (much as that pains me). Chances are you will be excused after the first day.

That said, you may be able to get a doctor's note asking that you be excused due to your lower back/hip pain, which prevents you from sitting for long stretches. That's all I got.

DCB, I just know it's King's County but don't have the summons with me and don't recall which court it is. At least it's convenient. I can walk there in minutes.

The doctors note (from Mrs Dr DCB, naturally) didn't work for me.
I went to Federal Court for one day.
Had to call in after 5pm everyday for 3 weeks.
Big Mafia trial.
I hit them with all the BS I could think of as an excuse - but finally I think I got out of it just because of the random nature of the mindless, grinding bureaucracy.

OK, well at least it's New York State court and not Federal Grand Jury Duty. There is almost no way out of Federal Grand Jury Duty.

You get at least one automatic deferral, or have you used that already? Other than a physical injury, it's not easy to get out of jury duty anymore. Chances are you won't be selected, and will have to waste a day sitting there (for which they pay you $40).

If you get called for voir dire, then you have to try to answer questions in such a way as to convince the lawyers they don't want you on their jury. You don't trust the criminal justice system, you're currently in litigation (e.g., with a contractor), you have a sister who was in prison, etc.

If it says Kings County, it is most likely NYS Supreme Court, Kings County -- ie State court. It's typically one day, unless you are picked on a jury, or if your panel is still selecting and does not dismiss you by the end of the first day. Most of the cases are civil and typically tort cases -- and the lawyers pick the jury with very little judicial oversight.

I was called for a panel for a trial that was supposed to last 2 weeks. Little conference with the lawyers, told them I had family obligations that would make it impossible for me to be there for that long, excuse accepted. Stayed the rest of the day and excused, don't have to go back for 10 years.

Biff, if you find an excuse not to go right now, they will call you again within a year or so. I ignored several summonses and then finally went when I was worried that they would issue a warrant for an inconvenient time. One day every 10 years? I can live with that! And they have wifi and computers for potential jurors to use.

I have been in court since April with my ex-wife.
She just fired her second lawyer and hired her third lawyer, who refuses all contact with my lawyer.
Yesterday I got hit with a new order to show cause with 8 demands:

3 of the demands are totally inconsequential.

2 of the demands would be disastrous financially to me as well as our children.

1 of the demands was already decided against her in a prior decision of the judge. I already offered after the decision to give it to her anyway just to be nice. Apparently she wants to litigate it anyway.

1 of the demands would be disastrous to the entire legal system

1 of the demands would prolong the case forever

I am only seriously worried about the last one.

Slopey, amazingly enough I've had the final decree since 2008. This is all post judgment.
I am very happy with my lawyer. Came highly recommended by my original divorce lawyer, the Master of the Universe,with appropriate astronomical fees to match.
My current lawyer has a brilliant legal mind and takes the high road, which I appreciate.
However, lawyers with brilliant legal minds are rare and in ridiculously high demand, so hard to get much attention from her.
By now, everybody dislikes my ex-wife, including her first 2 lawyers, and the Judge.

Yes, I thought I remember reading the divorce was final. Sounds good about your attorney. If the Judge has been PO'd in the past at your ex, that should help, too, in terms of how the judge resolves the motions. Good luck.

My experience has definitely been that judges do not like it when the lawyers do not talk to each other and try to work any problems out before requiring judicial attention. Can't speak for your judge, but if her lawyer won't speak to yours, most judges would not like the sound of that. Obviously, the merits of the motion are thte most important thing, but to the extent it turns on competing characterizations of the facts and their import, it helps to have the lawyer the judge is inclined to view as more credible and more likely to be candid with the court.

How to really piss off a judge
1. Continually whisper with someone in open court while the judge is attempting to give you constructive advice
2. Attempt to do an end run around the judge by bringing a motion in a lower court
3. Get assigned a free lawyer by gaming the system and lying about assets (Judge ended that one fast)
4. Regularly fire and not pay your lawyers
5. As Slopey already said, refuse all efforts at discussion or compromise

Harsh for your friend, Arkady. Justice does not come easily or on the cheap.

My case is amazing. I have already provided for my kids college, in full. Unfortunately for all of us, I agreed that she could co-manage the trusts.
Now she wants the money handed over to her control, and for me to pay for college separately, with new money.
The whole story is even worse, but I really can't talk about it.

Yes, any or all of those 5 would do it, dcb. When I was home sick last week I watched a two hour CLE video on "Judges' Pet Peeves." A panel of state and federal judges. I thought it would be interesting, or at least entertaining, with lots of war stories about stupid lawyer tricks, but it was painfully boring and didactic, and the advice was absurdly obvious. Anyway, it would seem dcat is now qualified to teach that course.

Painfully obvious judicial comment # 37 -- "If you are arguing a motion and the judge asks you a question and the answer may not be helpful to your cause, don't tell the judge the question is not relevant."

Turns out my battery problem is from using it on the weekend for just short stop and go trips and not enough highway to bring it back up to full charge. I'll put it on a battery tender from now on.

I wonder if she is getting bad advice in the matter of how to get financial aid for kids going to college. The formulas for need-based aid can work in favor of a custodial parent (for financial aid purposes, the parent with whom the student spends the most time) who has assets but little income. However, just because the the family demonstrates need does not mean that the student will be given aid. Most college don't meet demonstrated need. Sure, Harvard give free rides to any family with an income of $60k or less (without considering retirement savings or home equity) and generous aid to families with income up to around double that, but (duh!) not every kid gets into Harvard.

For me it's different, MM. As a New York Jew growing up in the 70s, Woody Allen was a big deal. I loved his movies, bought the 2-LP set of his standup routines, etc. So much bigger deal for me to disown him. I've had a friend's parents (who live on UWS) tell me I'm no longer Jewish because of my wholesale rejection of Allen.

I worked w/ him in the '60s at the Bitter End (NH) & never liked his stuff. It really bothered me that his 'bits' (NH) were just repeats of monologues he had given on his psychiatrist's couch & that people laughed at them. Laughing at an emotional cripple really is no different from laughing at a physical one.

When I first saw his early movies, when I was in college in the 70's, I didn't get it at all, as I didn't know any typical "nebbishy New York Jews," or much of anything of Jewish culture in New York City, period. That didn't happen until I moved here.

I did manage to have a remarkable command of Yiddish words and phrases, in spite of that, from obsessively reading old reprints of Mad Magazine from the late 50s, early 60s. Who knew?

I read Diane Keaton's memoir (had great hopes for it due to her co-author, Anna Quindlen, and plenty of pretty good reviews) and was very disappointed that she is still aligned with Team Woody (nh, as far as I know). And she has a teenage daughter.

I liked his early movies a lot but looking back on Hannah And Her Sisters, there are early signs of his character flaws.

I still enjoy watching some of Woody's movies.
Annie Hall is one of the best relationship movies in my opinion. I think it still holds up well. So many other relationship films that came later are informed by Annie Hall's unflinching look at interpersonal dynamics with a comic twist.
There is one of his more recent films that's worth watching, Match Point with Ewan McGreggor. Very well done and as with many of his recent films, worth watching just for the scenery alone. That one takes place in London.

I dated a girl who really liked Woody and we went to see him play his Clarinet at Michael's Pub on the upper East Side.
He played with an old timey jazz quartet. Very nice.

I felt so old when I made farmhand listen to all of Bruce's version of Santa Clause when a top 40 station played it last month, even making her stay in the car after we parked until the song finished. Legion, it's all over when they are old enough to ride in the front. then they can reach the radio and just change the station. farmhand doesn't actually like much top 40 but she hasn't found anything she likes better, so we sort of bond over some of the really bad songs. Pet peeves of hers -- Justin Bieber (he's kind of creepy), Ed Shearan (he breathes too loud), Fun. (why is this a song?). But she know that sunday, 5-6, I listen to Sound Opinions and that is not negotiable.

Appalled doesn't come close to what I thought about Woody Allen cheating on his "wife" with his "daughter". I couldn't even imagine how Mia Farrow could recover from that betrayal. I admit to reading that article in the Times though and it was pretty funny. Also, I have to say I have respect for friends who stay loyal to friends even though they are screwed up in some way, i.e. Diane Keaton staying friends with him. That is all kind of "qwurpjrl" inexplicable. I recall that Dori Previn was plenty upset at her husband cheating with young Mia (the father of some of Mia's children). Just sayin'. So I finally talked with a competent person at student loans today. She spent a good 45 minutes on the phone with me explaining everything. My last loan payment, if I continue to pay what is owed and nothing more per month, will end on Novevember 2024. That seems really absurd, considering I thought this was a 10 year payment program. I asked if I switched from graduated repayment (every year it goes up a little bit) versus a standard where you pay the same every month she said it will still roughly end around the same time and that it's up to me what works better. She told me that the year prior to 2024 that my loan amount will be 257. Right now my monthly on graduated repayment is like 126 or something a month. If I switch to standard it will be 198 a month. I'll be 47 years old in 2024 and still paying back student loans? Absurd. Turns out I actually only originally took out like 16K in student loans. But my current balance is a few dollars short of 24K even though I've been paying on time for the last 2 years. I guess 2 years ago it was closer to 26 or 27 maybe? My interest rate is super low. like 2.9 or 2.3 %. How can so much go toward interest if my rate is so small?

Interest accrues daily, (ANNOYING) and it starts the next day after you last paid. After my credit cards are paid off I am going to make an effort to pay a lot more toward these loans. Do you think it would be better to pay every two weeks, or do you think it's better to pay double the amount in one lump sum each month?

I have monday off for Kings day too!!! We got to pick either MLK Jr. Day off or Presidents Day. I knew everyone was going to pick Presidents day off and that's why I picked Kings day off (that I feel icky working on MLK Jr's day anyway).

Will do, tho I actually think I know the answer to it. It's a very low interest loan so best not to get too aggressive with it. I have to focus on throwing a LOT of money toward Duke/Dentist's CareCredit card and my regular credit card since those are very high interest. Actually the carecredit card is alway manageable because you have 6 months to pay zero interest and I've always been able to do it, and what's left on that card from Duke's hospital, vet, cremation expires in June. In late May I have my free 2 weeks of bills/rent so I will throw it toward that and it should be fine. The credit card I need to pay off my with tax refund, and then what is left aggressively pay it down because the zero percent APR expires on March 1st. Shouldnt be too bad really because I would guess after my refund check, if it's similar to last year, and barring I do not use my credit card anymore, will be about 900 bux, but at 29 percent interest that could get kinda hairy.

My ultimate goal is to be debt free (credit card and care credit card by the beginning of summer), well other than student loans (which most people consider is good debt as long as you are paying it down on time which I have been for a number of years).

Once I have the credit card down to a zero balance, see if I can get it switched to a new card with 0% APR for 9-12 months and use that to go down and visit my grandmother in south carolina and also take another trip to california this summer.

I am really good at paying my bills on time and figuring this all out, but when it comes to really stupid purchases, not so much.

One novel idea to get this done even FASTER and way more efficient would be to quit smoking, yet it's something my brain is totally not letting me do for some reason. I can't seem to get to the point of saying, JUST QUIT you will have an extra 400 dollars a month.

Nicorette didnt help.
The Patch didnt help.
E-Cigs didnt help (that actually made it WORSE).

I'm a tad loathe to try hypnosis, but lots of people say it has worked for them. I really don't want to get hypnotized because I don't want a gazillion rattling skeletons in my closet parading out that locked door, like the first time I tried ecstacy back in the day :-/

I got to participate in one of the coolest traditions of the Harbor School. We went to The South Street Seaport to work on the oyster project there with one of the Freshmen field trip classes. At the end we had a "Oyster Celebration" where each kid gets to throw back a freshly shucked oyster from Fisher's Island. Out of 29 students, 25 actually had an oyster. One of the other volunteers had the extras. Briney goodness, yum.

(that pic isn't the dog hahaha it was just some random picture that kinda reminds me of this dog, who I have been wrestling, playing, and screaming with since I ate dinner). I've never had an organism push my limits so much as this puppy. I don't believe in discipline, but I promised my roommate I will discipline him when he acts bad (which is like ALL the time) except I feel like people in my building hear me disciplining and a dog and being all like omg listen to that homo disciplining that dog! My dog came disciplined when I got him, and I was never disciplined as a kid, so this is a really foreign concept for me, but I think I am making it work. Well, not really, this dog already has established his dominance over me, and I dont think there is anything to do about it at this point.

If Duke acted like this when I first got him I would have sent him right back in a cab back to Jersey.

Than god Dudley and Dinky are keeping me sane, now THOSE pets know how to act proper and stuff.

One of my roommate's friends bought him a squeaky toy thingie. Oh HELLS no. that shit is GONE. I broke the squeaky part of it. If I heard Eeeeeh-AWWWW-EEEEAWWWWW one more time I would go all Kimberly Shaw ALA Melrose Place on this building!

The harbor school uses my boathouse for their rowing program. I'm friends with a lot of the teachers there & I love teaching the freshmen how to row our gigs. This class is a field trip class that goes all over the ny harbor & this is just one of the segments that they do. On the whole, I'd prefer to be gainfully employed. But today, I worked for oysters.

rob, with interest accruing daily, it's better to pay off every 2 weeks. i think some student loans might have mortgage-style amortization (paydown) ie; interest up front, principal back ended. that would explain your situation. i can check tomorrow...
