Romney contended that he had “no role” at Bain after 1999 when some of its companies went bankrupt, shipped jobs overseas and fired workers. He remained the firm’s chairman of the board, C.E.O., president and only stockholder until 2002. Other than that, he had nothing to do with the place.

Usually, at this stage of a presidential campaign, Republicans are doing a much better job of sullying the Democratic candidate as un-American. Michael Dukakis was accused of having a funny last name and failing to say the Pledge of Allegiance 10 times a day. John Kerry was faulted for acting French and eating Philly cheese steaks with Swiss cheese. Al Gore was into the earth and earth tones — need we say more?

Instead, he attacks business.

Being the head of a financial company, even a large one, and being president of the United States are hardly similar jobs. It might sound all nice and neat in stump speeches, but any POTUS has tons more on his plate on a daily basis than a CEO does in a year. Comparing them like they are equal is ludicrous.

It's simple:

1. Romney says -- elect me. I know how to create jobs. Look at what I did at Bain.
[1a. Romney doesn't say -- elect me. Look at what a great job i did as governor. That would mean running on, not against Obamneycare.]
2. Obama says -- ok. Let's look at Bain and see what it says about Romnry and job creation. Oops, looks like a lot of outsourcing and layoffs.
3. Romney says -- hey, no fair, that's after I left in 1999 to turnaround the Olympics.
[3a. Romney also says -- but I still get to claim credit for jobs added after 1999, just not the blame for the outsourcing and layoffs.]
4. Boston Globe -- not so fast. That's not what you told us when you were running for governor and that's not what your SEC filings say.
5. Obama says -- I told you so.
6. Romney says -- pay no attention to the fact that I told the US government I owned and controlled bain through 2002, I am not responsible for what happened after 1999.

The issue is whether Romney gets to claim he knows how to create jobs and back it up by citing his time at Bain. It's fair game and it is not an attack on capitalism to point to Romney's record at Bain. And, in light of 6, it also raises accountability issues. You wall street folks are way too thin-skinned if you think this is an attack on capitalism. It is an attack on Romney's chosen central rationale for his candidacy. He put it in play -- it is fair game.

It's rather sad that Romney's health care program in MA, which he was very proud of, and deservedly so, is now something he's so ashamed of, he'd rather the other side take potshots, some deserved, some not, on ANYTHING other than that. That's a big reason why he's not going to be president.

You did it, you were proud of it, it was good for the state. OWN IT. Instead, just like McCain, he's allowing himself to be remade in an image of someone he is not, in order to appeal to the far right, a group that hates him almost as much as they hate Obama. Although I disagree with most of the policies of both men, (Romney and McCain), they are basically decent people who probably wouldn't be the worst presidents in the history of the country (that position is filled), but their palpable pandering to a minority even within their own party, not to mention the country, is really disappointing, sad, and fails every time.

Assuming that's really true, I understand he probably didn't make the decisions, but he's still accountable for what happened as owner/ceo etc. Your point is a very hard sell. And it's not like saying "I left in 1999 and a bunch of idiots took over and changed course." Bain did what Bain does, before and after 1999. Romney looks like he's trying to squirm out of something -- if what Bain does is good for US economy, good part of capitalism he should just own it politically and make a robust case for it and not engage in Clintonesque parsing.

We disagree on so much about healthcare and that isn't the point. But the key campaign point is that Romney is not out there saying as a principle rationale for his candidacy "Look at what a great job I did as governor. Look at the amazing health care law I passed and how well it is working." He merely defends it as an afterthought when necessary along the lines you suggest. So he features Bain instead, which makes it fair game.

That sounds great, Eva. We did that too, in the summer. Berries are my favorite.

We used to pick wild blueberries on my best friend's property, and tons of blackberries and wild raspberries on our land. Whenever I buy those puny little containers of often tasteless blackberries now, I'm reminded of what we used to take for granted. I'm going to plant them in Troy, and have fresh berries again.

Her fave episode was Cosby and a friend playing cards with his dad and a friend, and the dad and friend try to cheat through not so subtle coded dialogue. Like, "tomorrow, I plan to go golfing, so I need to remember to bring my clubs." To this day, when we play cards, it's always the queen of "going to the garden to get a spaaaaaade."

Cosby Show was great, but nothing beats his recordings of his stand-up routines. They are timeless and absolutely brilliant. Our family used to literally gather around the stereo and listen to them when I was a kid. He shaped my sense of humor more than anyone else.

MM -- I didn't grow up listening to Cosby stand up. I had two Robert Klein records, plus Woody Allen's "Night Club Years." Discovered early Richard Pryor records in middle school. Loved the routine about a playground fight with one guy talking so much shit about how he would beat up an obviously bigger and stronger kid. he kept trash talking because his friends were restraining him to avoid a fight, so he thought he was safe. "And then we let him go." Such a good storyteller in his prime. The best comedy is really storytelling.

I suspect Lenny Bruce records aren't that funny. It was the edge he walked live that made the act, not the jokes.

Speaking of Village Vanguard, I highly recommend that any jazz fans hightail it there this week or next (I think he's there next week -- two week run) for the Barry Harris trio. It's his 80th birthday, and he is a great bop and post-bop pianist and one of the most important teachers of jazz musicians over the last 50 years. Great trio with Ray Drummond (bass) and Leroy Williams (drums). I hope to get there on Tuesday.

There really is no better place to hear jazz than the vanguard. back in the 80s, so many great players were still around and playing well, but -- Japanese tourists aside -- the audience was small, so you could pay a $7 cover and nurse a beer or two over three sets on a weeknight. Best night was Sunday -- the end of a 6-night engagement. Band at its best after playing together the whole week but only serious fans in the club, and lots of surprise guest drop-ins, usually in the third set. Energy always phenomenal. Now, far more casual listeners, so much higher cover charge and rare to be able to stay more than one set. Good for the musicians, good for the clubs, but less fun for the fan. On the whole, though, I'd rather see the musicians get well-paid. They deserve it.

Names won't mean much to anyone else, but those guys were all amazing musicians. Some are still around but much mroe difficult to see.

35 NY Jur Criminal Law Substantive Principles and Offenses § 158

§ 158 Use of force in making arrest or in preventing escape

The use of physical force upon another person which would otherwise constitute an offense is justifiable and not criminal where the person, pursuant to the provisions of the Penal Law governing the justification defense, uses physical force upon another person in order to effect an arrest or prevent an escape from custody. Whenever a person is authorized by such provisions to use deadly physical force in any given circumstance, nothing contained in those provisions may be deemed to negate or qualify such authorization.

Accordingly, a police officer or a peace officer, in the course of effecting or attempting to effect an arrest, or of preventing or attempting to prevent the escape from custody, of a person whom he or she reasonably believes to have committed an offense, may use physical force when and to the extent he or she reasonably believes such to be necessary to effect the arrest, or to prevent the escape from custody, or in self defense or to defend a third person from what he or she reasonably believes to be the use or imminent use of physical force. However, deadly physical force may be used for such purposes only when the officer reasonably believes that:

(1) the offense committed by such person was (a) a felony or an attempt to commit a felony involving the use or attempted use or threatened imminent use of physical force against a person or (b) kidnapping, arson, escape in the first degree, burglary in the first degree, or any attempt to commit such a crime;

(2) the offense committed or attempted by such person was a felony and that, in the course of resisting arrest therefor or attempting to escape from custody, such person is armed with a firearm or deadly weapon; or

(3) regardless of the particular offense which is the subject of the arrest or attempted escape, the use of deadly physical force is necessary to defend the officer or another person from what the officer reasonably believes to be the use or imminent use of deadly physical force.

The fact that a police officer or a peace officer is justified in using deadly physical force under such circumstances does not constitute justification for reckless conduct by such officer amounting to an offense against or with respect to innocent persons whom he or she is not seeking to arrest or retain in custody.

Commentary: Even though an officer may be justified in using deadly physical force to arrest a person or prevent an escape, that officer may not act recklessly with respect to innocent persons. Thus, while the officer who pursues an armed robber through an area crowded with people may have the right to shoot the robber in order to effect an arrest that right is qualified and superseded by the officer's duty to avoid injuring innocent persons by the reckless use of his or her pistol. If the officer both intentionally shoots the robber and recklessly kills a bystander, the fact that he or she was authorized to do the former does not justify the latter. On the other hand, the officer's justification for shooting the robber is not negated by his or her reckless shooting of the bystander.

Caution: The Fourth Amendment prohibits the use of deadly force by a police officer to prevent the escape of a suspected felon unless it is necessary to prevent the escape and the officer has probable cause to believe that the suspect poses a significant threat of death or serious physical injury to the officer or others. Thus, a state statute which authorizes police officers to use all necessary means to effect the arrest of a suspect who flees or forcibly resists arrest after being notified of the intent to arrest is unconstitutional insofar as it authorizes the use of deadly force to prevent the escape of an apparently unarmed suspected felon.

Illustration: The trial court's consideration of the statute on the justification of a police officer to use physical force and the elements of manslaughter provided the appropriate standard by which to measure the reasonableness of the defendant police officer's conduct, in a prosecution for manslaughter arising from the defendant's shooting the victim in the back while the victim was fleeing.

A guard, police officer, or peace officer who is charged with the duty of guarding prisoners in a detention facility, or while in transit to or from a detention facility, may use physical force when and to the extent that he or she reasonably believes such to be necessary to prevent the escape of a prisoner from a detention facility or from custody while in transit thereto or therefrom.

I don't agree. I don't see either man as evil by any means. They are both quite smart and capable and talented.
And I believe anyone who steps up and runs for office should be commended and not disparaged as 'just a politician. Those that stand back (talking heads, pundits, etc) and spew complaints and critiques and do nothing but foment cynicism and distrust would be the evil.

I heard about that article kazoo but didn't read it.
The brain functions as a supercomputer with amino acids as the binary code structure. Any repetitive behavior will begin to "encode" within the structure of the brain matter itself in the form of complex neuronal connections. There have been numerous studies where people who are very active in video gaming have overdeveloped centers for processing that type of sensory information. The brain is a very "plastic" organ. It can change according to need and people can even function with half of it gone (for real). Don't know how much of this would translate into an evolutionary force since evolution requires several external factors. So you would need a group of avid video gamers being sent off to Mars to colonize that planet and left in isolation for a hundred years to achieve some sort of evolution. Oh, and the video gaming skills would have to offer some evolutionary environmental advantage in order to survive and pass that trait along.

There are two problems with your interpretation slopefarm:
First, this statement was made in the context of what is clear to everyone as an appeal to set "classes" apart in our nation instead of understanding that there is a fluid dynamic to class structure in America. This is ironic in that he himself is the ultimate example of the fluidity of class within our nation.
Second, is the sustained belief on his part that what ails America is the lack of something on the part of those who are not in the "wealthy" class. When in reality, what sets this nation apart is the overwhelming bounty available to all people, all the time. What ails this nation is a lack of leadership when it comes to priming the engine that produces the jobs which bring meaning and direction to many people's lives. There is his great flaw because jobs are not created by fiat against the rich but by encouraging INDIVIDUAL acheivement.

This has been the number one mantra from Team Obama and the Left from day one. The idea that keeping one's hard earned money is somehow an affront to the society at large. Nevermind the fact that much of these tax cuts were aimed squarely at the middle class who were somehow lumped in with the "rich" for the past four years.
What's my proof? The fact that the President is now considering retaining the "Bush tax cuts for the rich" for the middle class. Huh? I thought all the beneficiaries of those tax cuts were "rich"? Guess not, guess they were actually middle class store owners, business owners, entrepeneurs, etc.

My daughter does what she wants. She does do her chorus but that is her choice. I do think it's a good thing for her to have a different social circle than the one from school and she has that at chorus, but there's no way she'd do it if she didn't want to. Wind drove the rain so hard against the front of the store that the door seal failed a bit. Nothing terrible, but needed to mop up. When it let up I went out for a smoke. It's hard to smoke a cigarette without getting hit up for one. This is the new norm here. I'm usually asked twice a day. If they offer to buy one, the standard rate is a buck. I always tell them, "no, I only came out with the one." I'm starting to think I've been missing a good opportunity.

Exaxctly. Obama and his ridiculous left wing class warfare and continuous attack on the wealthy and the ability to earn wealth is truly the worst thing that's come out of a Presidential mouth in many decades. there has never been a Democrat so socialist as this. It's really bad for the country.

Hi Eva.
It was great! Seven of my closest girl friends joined me for a yummy meal and a rehashing of our Bermuda trip. We got to see the first round of wedding photos and giggle a little. A couple of them had not been to my new place yet so the first hour consisted of too many ooo's, ahhh's and questions while I was desperately trying get dinner going. We had dessert (just farm fresh L.I. berries and some more rose wine) up on the roof terrace by the lights of the city. Very nice indeed!

I'm making a spinach/greens salad with fresh red peppers and cucumber, sliced fresh tomatoes, and broiling a piece of steak to slice up. Dinner! Voila!

I just can't decide what kind of salad dressing to make with this....

Cosby: saw him in person when he did a concert in the city near my hometown - it was one of the most exciting things I ever did! Best routine, from album "Right": Noah ("...what's a cubit?) - brilliant. We used to be able to quote the routines word-for-word on double dates, and laughed til we cried.

Bradley's: near where I lived but always too crowded for me to stay

Never had canned whipped products at home. cream should be whipped from scratch.

Can't get into political discussions - statements about Obama are too ridiculous and false for words.
