ON GOVERNMENT OVER-REACH: This
should be, rather obviously, filed under the heading, “You
Can’t Make This Stuff Up,” but a kind young lady… Ms.
Schyler Capo, of northern Virginia, saved a baby
woodpecker from the jaws of a neighborhood cat
recently. Having saved the young bird, she took it home
to nurse it back to health before returning it to the wild. A
federal bird and wildlife official, having heard of her good
deed did what any self-respecting government official
would do under the circumstance: he fined her….
$525!!!... for transporting an endangered species.
Actually, to be fair, the official fined young Ms. Capo’s
mother, but that seems hardly to soften the stupidity of
his action.

This is the very heart of the problem with government
these days: it is too intrusive; it is too “Big Brother-y” and
it is “stoopid” beyond belief. But such is what the Left
creates when it allows government to become so large
and so intrusive that it errs in manners such as this.

i dont like the term bisexual. also is there a statute of limitations on prescription medication? i have a prescription from 2009 that i was supposed to get filled but i never bothered but now id like to get it filled. will they let me or has too much time passed?

also, with the new plan we have three options... all three take different amounts out of our check. the cheapest plan that takes the last out of our check has a 5000 dollar deducitble (ouch) but the first 2500 of that is covered on a health flex giftcard. the cheapest plan that takes the least amount of money from our paychecks is one with a 2850 deducitble (still get the 2500 gift card) so that isnt so bad, but it's for in network doctors only (it's oxford and i think it's easy to find doctors who take that). the middle plan is the 2850 deductible (2500 gift card) that is in network and out of network.. i wouldnt go to an out of network doctor anyway cuz it doesnt cover 100%, tho you can still pay for it 100% with your gift card but i dont think it goes to deducitble? ugh insurance is so f'ing wonky. which plan do you think is the best? im thinking the in network one with the lower deductible?

yes, stay in network. if you go out you'll have to chase them for the payments and make the payment to the doctor yoursdelf first

You can always use the card to pay at the office though. That said, many doctors don't take those cards and you have to pay them and then get reimbursed

Is that an owl? Some very large bird. Wow. I have seen sparrows, starlings, robins, bluejays and once a cardinal
in my backyard. Never anything more exotic but then I don't have a birdfeeder. They like my backyard I guess for all the seeds from my giant tree but how good could they taste?

Dave, ok, the next time I see you please explain DSK to me. The other thing that fascinated me about that whole incident is the reaction of the French people. I know a couple of Francophones and one Belgian woman was incensed about the perp walk, something which I think most French people hated (and just a part of getting arrested here). Tried in the press, made to stay in jail without being proven guilty, etc. etc. And then it became a forum for French people to weigh in on the Puritanism of Americans, then a discussion about the different views on casual sex, monogamy, flirtation and seduction as a part of French life, the French psyche. What a bunch of punitive creeps we are, etc. etc. There was one guy, ex-minister of Culture of all things, this guy Jack Lang, a friend of DSK and OUTRAGED, yes, OUTRAGED, that the guy
was even arrested, a man of his stature, in JAIL, and kept saying things like "Nobody died", called it --don't know French -- an expression related to the lord of the manor getting dibs at the help. But also it seemed to stir up discussion in France about where is the line between that "he he he, we are so sexxxxy" and genuine thuggery and aggression. We really went through this here - that discussion - and sometimes there is overkill where people are afraid to tell you that you look nice or where some bitch uses sexual harrassment claims to hurt a man (I saw that happen once, so awful) but I think we
made some progress in the workplace on making it easier for people to work together.

yeah ive been hearing from a lot of people that lots of doctors dont take those cards (it's essentially a debit card so i dont get why not!!! they get paid up front). it's really annoying cuz there's really no times i will just be able to pay up front at the doctor. i dont like the whole idea of paying up front and then getting reimbursed, waste of time for so many parties involved and one of the reasons healthcare costs so much anyway! too much red tape crap

dona - The suet feeder is only 4 inches so the 'pecker isn't very big. I have 6 feeders, each of which attracts different birds, so I get a lot.

my backyard -- actually greater Brooklyn I think -- because of the massive Norway maple which towers over my

I had a prescription with refills and the pharmacist told me that the refill was over a year old, which is the cut off.
Depending on the prescription (and your doctor) sometimes the pharmacist will just call your doctor and get
a new perscription over the phone.

I had an Rx rejected that was just 6 months so I extrapolated the 3 months - maybe just my pharmacy. I'd got 2 for the same thing from 2 different MDs & thought I'd use the 2nd rather than go to doc for new one. Maybe it has to do w/ numbers of renewals?

I dunno, I have the same thing. I guess the only reason is that it's expired, and so it's not valid, but I can't think of any reason to renew it! So I haven't! And people STILL accept it, which is weird but good.

Dona - I used to fight squirrels & kept losing - baffles on feeders, etc. Then I started feeding the squirrels their own stuff - compressed corn logs that go on a spike on the fence. I still keep the baffles but squirrels pretty much stay off the feeders now.

Rob, they issue you a new card, so you can hold onto the old one for nostagia's sake. But get a current ID. It will make your life so much easier. We're getting to the point where you need "papers" to get or do anything. Fighting the system is futile, unless you plan to spend the rest of your life off the grid in the woods of North Dakota.

im looking at my current ID and it says my eyes are green. will they have to change that when i get a new ID if my eyes are no longer green? i dont remember them measuring me, ever, yet it has my correct height (i think they just asked at one time and take your word for it?) would be doing a disservice wearing colored contact lenses when i have to take a picture for a new ID? do they even do new pictures or do they just add your old one? i dont really like my old one.

Richard Fisher is the President of the Federal Reserve Bank of Dallas, and we
believe he is the only President without a Ph.D. in
Economics. He has, instead, his MBA, and to be quite
honest, we think this is a benefit not a detriment.

This is what he recently said and I believe it sums up the current issue with jobs and the government and what is going on:

I have spoken to this many times in public. Those
with the capacity to hire American workers?small
businesses as well as large, publicly traded or
private?are immobilized. Not because they lack
entrepreneurial zeal or do not wish to grow; not
because they can’t access cheap and available
credit. Rather, they simply cannot budget or manage
for the uncertainty of fiscal and regulatory policy. In
an environment where they are already uncertain of
potential growth in demand for their goods and
services and have yet to see a significant pickup in
top-line revenue, there is palpable angst surrounding
the cost of doing business. According to my
business contacts, the opera buffa of the debt ceiling
negotiations compounded this uncertainty, leaving
business decision makers frozen in their tracks.
I would suggest that unless you were on another
planet, no consumer with access to a television,
radio or the Internet could have escaped hearing
their president, senators and their congressperson
telling them the sky was falling. With the leadership
of the nation?Republicans and Democrats
alike?and every talking head in the media making
clear hour after hour, day after day in the run-up to
Aug. 2 that a financial disaster was lurking around
the corner, it does not take much imagination to
envision consumers deciding to forego or delay
some discretionary expenditure they had planned.
Instead, they might well be inclined to hunker down
to weather the perfect storm they were being warned
was rapidly approaching. Watching the drama as it
unfolded, I could imagine consumers turning to each
other in millions of households, saying: “Honey, we
need to cancel that trip we were planning and that
gizmo or service we wanted to buy. We better save
more and spend less.” Small wonder that, following
the somewhat encouraging retail activity reported in
July, the Michigan survey measure of consumer
sentiment released just recently had a distinctly sour
tone.

Importantly, from a business operator’s perspective,
nothing was clarified, except that there will be
undefined change in taxes, spending and subsidies
and other fiscal incentives or disincentives. The
message was simply that some combination of
revenue enhancement and spending growth
cutbacks will take place. The particulars are left to
one’s imagination and the outcome of deliberations
among 12 members of the Legislature.
Now, put yourself in the shoes of a business
operator. On the revenue side, you have yet to see a
robust recovery in demand; growing your top-line
revenue is vexing. You have been driving profits or
just maintaining your margins through cost reduction
and achieving maximum operating efficiency. You
have money in your pocket or a banker increasingly
willing to give you credit if and when you decide to
expand. But you have no idea where the governgovernment
will be cutting back on spending, what measures will
be taken on the taxation front and how all this will
affect your cost structure or customer base. Your
most likely reaction is to cross your arms, plant your
feet and say: “Show me. I am not going to hire new
workers or build a new plant until I have been shown
what will come out of this agreement.” Moreover, you
might now say to yourself, “I understand from the
Federal Reserve that I don’t have to worry about the
cost of borrowing for another two years. Given that I
don’t know how I am going to be hit by whatever new
initiatives the Congress will come up with, but I do
know that credit will remain cheap through the next
election, what incentive do I have to invest and
expand now? Why shouldn’t I wait until the sky is
clear?”

MM, I didn't know the French expression, but I did know that about the Marriage of Figaro. That was a kind of revolutionary
opera from the perspective of social change. I love that opera too. But then Suzanna who was sort of into the idea is sorry and sings to her husband "Beat me, beat me" like slam me around a little to punish me. Jeez. I love opera. It is all about sex, some of these people have primitive problem solving skills though. Yeah, DSK and his buddies gross me out.

Arkady, that is a great idea about the squirrel stuff. Maybe I'll try that someday. I know they would still rather get into my house. Probably in squirrel circles, they still talk about the guy that got in and gorged himself on candy bars and then walked his chocolate paws all over my couches.

Gort, I hear you. Never mistake economic activity in NYC for the mood across the country as a whole. The real estate market here is firm, office vacancies are low and you're right, lots of spending. The rest of the country (except maybe Silicaon Valley and SF) are still really hurting, EXCEPT the corn belt. I think Iowa has 3% unemployment.

I was promoted last week. I have a "real" job now. I have a "real" job now. The best part of going from giving away the company's money to bringing it in is an office with a view AND a terrace. I suppose the terrace is part of our health plan...if things really tank, exit stage right and jump.

DIBS, dick bove is a good analyst, but I have a hard time believing anyone who firmly says a bank with a $1tln+ balance sheet either does or does not need capital in an environment like this. balance sheets at citi, bofa, even jpm are black holes... there's no publicly available information with enough granularity to make a rigorous assessment, so you have to rely on guidance from management. even if you're an analyst like him with great access to management, he's still forced to take their word for it...

Yesterday a colleague was telling me she got transferred, involuntarily. She then added once her wedding took place next year, they were probably moving to San Fran or Portland. A lot of 20somethings seem to tire of New York very, very quickly.

Dave, I really think the old screed that the government is preventing small businesses from growing or starting because of all the regulation, is really tired by now. I think the ball needs to be tossed back to those who are really stopping new businesses - banks. They are unwilling to lend, and are using the economy as a justification for sitting on piles of money. It's amazing that a bunch that had no problem speculating on billions of dollars of unsecured mortgage based assets and futures, now are as timid as virgins in a bar about investing in small business. Small business growth is the one thing all economists can agree upon, as being vitally important to lowering unemployment and growing the economy.

I have a girl in the neighborhood who I see every once in a while for massage who is incredible, but it hasn't seemed to help my lower back that much. a chiropractor just opened a second office down the hall from her. he's been practicing in the west village for decades and the location is convenient so I made an appt with him. it's a free consultation, so I figure I've got nothing to lose. definitely open to booking something with xing too.... I just want to start addressing this before it gets worse.

MM, you are on the rt track about the banks. Govt policy does not encourage banks to lend to small business. In fact, govt policy is destroying community banks, which is where small business loans are made.
You are on the wrong track regarding over regulation, which makes it impossible for small businesses to comply.

supposed to be free but who knows how hard it will be to get a seat. There are supposed to be pre-opera talks
for which you pay 10 bucks and get to plunk your butt on one of the chairs so maybe that is a way. But they are

FYI -- per yesterday's discussion, here is an analysis questioning the decision to drop the charges against DSK. It questions whether the extent of the "lies" was exaggerated to justify the dismissal. I do not necessarily agree, but it raises some interesting points. My view is that it is the lie about the previous rape that is most problematic. We're in the realm of judgment, not clear application of rules to fact, and the facts as they exist in a legal proceeding are not always the same as they are described in tabloid news coverage.

Lying about the rape as part of an asylum application doesn’t bother me. I’m pretty sure that’s standard procedure in asylum interviews - people in the camps get wind of a story that works, and adopt it as their own.

So yeah, fast forward to her interview after the event, and she’s afraid not to keep up the lie because she doesn’t want to be deported….sounds like a tricky situation to me.

My read, jb, is that Diallo probably was raped, but that the circumstances would not qualify as persecution under the standards that would alow for asylum, not that she didn't want to share it with some immigration bureaucrat. The lies were not about being raped but about who did it and why and the basis for future fear of persecution as a result. That would explain both why she lied and why she could give such realistic detail -- because it was all too real. Still, a difficult case for the prosecution here as a result.

DH, the erstwhile man in my life had an Iphone and he had so much trouble with it, I can't tell you. They are much improved
and now you don't need to have ATT which sucked at the time but I remember his having this problem. It was compounded by the fact that he was the total anti-techie. I wound up taking off my earring, sticking the post into a hole in the iphone and the no sim message went away and it worked.

everyone seemed to be psyched about iphone going to verizon - but most people i know with verizon iphones have much more problems than the at&t ones. (weird password errors, not working with google sync push)

i just couldn't get an android phone. its sorta like getting a lexus instead of a bmw. the lexus may have more features, be more reliable and is a better price - but bmws are da bomb jus cuz.

The flea is on my block and ocassionally I walk over there and look at all the stuff I would never buy.
It is a big foodie thing now so maybe they should be getting more garbage cans. I really think that it
does almost nothing for our neighborhood. There is a nearby restaurant on Lafayette - Olio - which
gets some of the flea people so that's good, but to me, it is mostly just less parking spaces on Saturday.
That and the Brooklyn Tech football field which has soccer matches Saturday AND Sunday and EVERYONE
comes from somewhere else in a HUGE SUV which takes up all the parking too.

Bxgrl, there IS a person in France suing DSK for rape. A young reporter, close friend of his DAUGHTER's who was cornered by him and attacked. They were thrashing around on the floor and she fought him off, talked about it on TV years later calling him a "rutting chimpanzee". His act is well known in France, even admired. The maid strikes me as somebody who is a bit of a hustler but not necessarily a crook or hooker or criminal, although her boyfriend is a lockedup drug dealer and she mysteriously had a 6 figure bank account with money parked in it by "others". ok then. So you have two people who do not win the Boy or Girl Scout of the Year award, but something bad happened to her there....nobody knows exactly what. But she altered her story a lot and they realized they just couldn't present her as a credible witness.

I was sitting on the patio and talking to a friend in California and my patio couch started MOVING. I said to her, I don't know what the heck is going on over here, I never felt any movement out here on my patio, but this chair is shaking. Sometimes I feel the A train in my house, but I thought that was really wierd. A few minutes later she was reading a text from her sister telling her that she felt it in Westchester. So I came in and checked it out on google. Damn.

I was in the Loma Prieta earthquake in '89, that was a 6.9.

My apt. was up on a hill/bedrock so we just rocked and rolled, but it was VERY VERY scary! I actually left town and went to Tuscon for a few days after it happened.

Aug. 23 (Bloomberg) -- Homeowners won’t be covered by standard property insurance policies if there’s any damage following today’s 5.8 magnitude earthquake centered near Richmond, Virginia.
Earthquake protection is generally excluded from standard homeowners’ insurance policies, and consumers have to purchase coverage either as a separate policy or an endorsement to an existing policy, said Michael Barry, a spokesman at the Insurance Information Institute in New York.
Most people who buy coverage live in quake-prone states, such as California, Washington and Missouri, according to Janece White, a vice president at Warren, New Jersey-based Chubb Corp., the insurer of commercial property and high-end homes.
“It’s very infrequent,” that residents who live on the East Coast purchase earthquake coverage since during their lifetimes there’s never been a temblor that warranted it, White said.

I just finally spoke to Chip, my insurance adjuster from Travelers. He was flown up from Atlanta to do the claims adjusting for the record rainfall the weekend before last. He will be here Sunday. I decided not to do any work on my tenant's apartment until he sees it. It is not too bad in her place but I want to get paid for this one and want him to see it first. She is not a happy camper, but welcome to my 130 year old house. This place is amazing. Last year between utilities, maintenance and repairs (stoop, apartments, water heater) I spent 21,000 dollars. And the roof is going to be at least 8 grand next spring.

I don't think that's a very nice/fair attitude, jessi. We pay just under market to live in an old house. And when something is broken, I do want it fixed ASAP. Fortunately, my building manager / LL is extremely responsive. And they should be. The property needs to be taken care of and well maintained. And the LL's rent roll has got to be close to $9,000/month. So they better fix stuff when it breaks! To be fair, though, the mortgage has probably been paid off for over 20 years.

She doesn't want to hear about my financial situation, the oldness of the house, the never fucking ending maintenance on this place and the fact that we just made a historical record for velocity and amount of rain. I understand where she is coming and I am going to deal with it and there isn't much more than I can do. I will fix everything. She has the floor above the parlor and the water came in through the masonry. We had a problem last spring too, but I thought the roof was ok after I dealt with it last spring. Newsflash, it isn't. So now I know that I need a new roof. She pays market rent. The other tenant has a cheapie rent and never has a drop of trouble. I have to raise that one next year. She just texted me, she's fine. You know what, I have some sympathy for dona's situation. It must be difficult to be over-extended and unemployed. However, that's not the tenant's problem. When you sign a lease, you sign it for an inhabitable space with a reasonable expectation that things will be maintained and fixed quickly. I'd think that you, as a lawyer, would understand that. And, if she's paying market, then she's probably pretty unsympathetic.

my biggest problem tenants were white guys over 30 more like 40. One was actor (who was in Oh Calcutta) who would come home and get high on crack I think and have screaming arguments on phone long distance at 1am and
could be heard easily into next bldg.
Other was divorced guy with teenage son who didn't pay rent and I had to go to court.
and I've rented to all ages, sexes, races, sexual-orientation.
Currently - everyone in house now is 50+ and gay.

My worst tenant was a hustler, sociopathic art director woman from Rome who I inherited with the building. I became her worst nightmare when she thought she would like to be a holdover tenant and forgot to move at the end of her lease. With her, I learned how to do tenant landlord court and with the help of a nice judge, she is happily on the next phase of her life. That was 6 years ago. The tenants I have now are great.

when i was in 3rd (maybe 2nd maybe 4th) grade i was out during hurricane gloria. that was amazing in a fucked up kinda way. someone wound up spotting me and driving me home lol. i was pissed

this upcoming weekend is a broke ass weekend for me so a hurricane would be nice (as long as it's somewhat mild and doesnt cause damage). i love the rain and thunderstorms but id imagine hurricanes are like getting gang banged? (dibs? is that the case?)

Old guy on the street claimed earthquake a sign of god's reaction to gay marriage.

Which, given the lack of any serious damage or casualties, looks like god thinks gay marriage is pretty okay.

I'm tired after several days of playing tour guide and trying to make sure my mom and step dad are having a good time.
So far, I think I'm succeeding.

I will definitely be at Ocean's 8 Thursday evening, and I'm pretty sure that Wendy will at least drop in for a while.

Scott, I think that you are pretty amazing, as a good host to your family. I understand that it is good to see everybody but that sometimes you just want some peace. I hope things go well and that you get to have a rest soon so that you can do what ever you want -- like go to White castle and test the rest of the offerings. j/k.
